Practice Areas

Ms. Malow has established her mediation and arbitration practice on her past experience as a trial attorney. For over a decade, Ms. Malow has served as a trial attorney in these areas of law:

Ms. Malow also has specialized training in:

Toxic Tort/Environmental

Ms. Malow served as co-counsel on an environmental contamination case of a neighborhood. She represented 3600 individuals against a major chemical company. The case involved personal injury and property damage claims. The case was settled for millions of dollars.

Personal Injury

Ms. Malow served as co-counsel on a personal injury case on behalf of an injured worker and his wife. The jury awarded over seven million dollars to the husband and wife. The case was settled after the verdict at mediation.

Ms. Malow represented a chemical company in a wrongful death case. She successfully settled the matter at mediation favorably for her client.

"Ms. Malow recently mediated a case in which I was involved and did an outstanding job in resolving a difficult case. Ms Malow was professional, well prepared and quickly understood all of the issues involved in the mediation. She also maintained a positive attitude throughout the mediation and had good communication skills, which allowed  each side to understand all of the contentions and issues being asserted.

The particular mediation involved an automobile accident case with several plaintiffs and was relatively small in value. I have found that these cases are often the most difficult to successfully resolve in mediation, but Ms. Malow did a fine job of keeping the lines of communication open to allow a final resolution. I would certainly recommend her as mediator and would use her again on other cases involving our office."

Employment

Ms. Malow defended a gas company against an employee who claimed racial discrimination. She obtained a dismissal of the case on a motion for sanctions against the plaintiff. The plaintiff's attempt to appeal was unsuccessful.

"Ellen did a great job on a very difficult negotiation involving an unrepresented party and helped us reach a resolution of a matter I had little faith could be achieved. I would use her services again in any employment matter."

Commercial

Pharmaceutical

Ms. Malow served as local counsel in Georgia for Bayer in cases involving strokes allegedly caused from taking cold medicine. Ms. Malow assisted with procedural and discovery issues.

Products

Liability / Asbestos

Ms. Malow successfully defended a chemical company in numerous suits involving contractors allegedly exposed to asbestos. These cases involved numerous parties and spanned decades.

Divorce / Family / Custody

Specialized Training

In addition to her law degree and general mediation training, Ms. Malow has received specialized mediation training in domestic relations which included a divorce practicum.

"Ellen has mediated more than one difficult case for my firm. Custody and divorce battles can be some of the hardest cases in which to mediate a settlement because there are emotional as well as monetary issues. Ellen seems uniquely capable of separating the two and more importantly getting the parties to separate the two, address them individually and come to a resolution that both parties can be happy with. It is often said that 'after a successful mediation both parties are a little unhappy.' I don't find this to be the case with Ellen's mediations. My experience has been that she delivers on her 'win-win' promise."
